Tier II Submissions

Under EPCRA, the federal law on emergency planning and the community's right to know about chemical hazards, a facility must file an annual Tier II report if, at any point during the prior year, it kept on site:

  • 10,000 pounds or more of a hazardous chemical, or
  • 500 pounds or more of an Extremely Hazardous Substance, or its Threshold Planning Quantity (TPQ) if that is lower.

Tier II reports go to the state's environmental agency, the Texas Commission on Environmental Quality (TCEQ), through the state's online Tier II reporting system. Copies must also go to the Local Emergency Planning Committee (LEPC) and to the local fire department. Because Fredville spans two counties, facilities here should send copies to both county LEPCs listed below and to the Fredville Office of Emergency Management.

Each Tier II form asks for basic facility identification, emergency and non-emergency contacts for employees, and these details for every chemical stored or used on site:

  • The chemical or common name shown on its safety data sheet (SDS, formerly called the MSDS)
  • The largest amount on hand at any one time during the previous calendar year, plus the average daily amount
  • A brief note on the way the chemical is stored
  • Where the chemical is kept within the facility
  • Whether the owner chooses to keep the storage location confidential from the public

Federal and state law both require this report every year. By March 1, report the hazardous materials your facility held on site over the prior calendar year.

TCEQ publishes detailed guidance on Tier II chemical reporting for Texas facilities.
