Zoning Board of Adjustments and Appeals

Fredville's Zoning Board of Adjustments and Appeals, or ZBA, hears requests for commercial and residential variances from the Unified Development Code (UDC). A variance may be granted when unusual conditions, a unique or restrictive physical limitation, or some other hardship means that following the UDC to the letter would make it impossible to develop a property at all.

The board also rules on requests to expand or phase out nonconforming uses, appeals of administrative decisions made by staff, and network node requests.

Rules for carports, accessory buildings and garage conversions are explained in the Planning FAQ.

Step 1. Apply

Applications are taken only through the city's online permit portal. New users register with a working email address, and setting up an account takes about five minutes.

Need help? Planning Division staff can be reached at (555) 010-8724, and you are also welcome to come to City Hall for help filing online.

Step 2. Application Review

Each variance request is reviewed by the Planning Division and then by the Zoning Board of Adjustments and Appeals. If a request is denied, the applicant must wait six months before applying again. The Unified Development Code lays out each step of the approval process.

Initial Submittal Requirements

  • A completed application and the application fee, both submitted through the online permit portal
  • An Agent Authorization Form, signed and notarized*
  • Supporting materials such as a survey, plat or plot plan, building elevations, a list of materials and photographs*
  • Current tax certificates showing that no taxes are past due or owed*

*Upload these documents along with your online application.

For more detail, see the City of Fredville Development Guide (PDF).

Fees

Application fees appear in the fee schedule of the Unified Development Code. You can also estimate your fees with the fee calculator in the online permit portal.

After you apply, Planning staff will confirm that your application is complete and then email you an invoice for the fee.
