Fredville's ZBA, the Zoning Board of Adjustments and Appeals, hears requests for commercial and residential variances from the Unified Development Code (UDC). A variance may be granted when unusual conditions, such as an oddly shaped or physically restricted lot, create a hardship so severe that following the UDC to the letter could prevent a property from being developed at all.
The board also rules on the expansion and amortization of nonconforming uses, appeals of administrative decisions made by city staff, and network node requests.
Questions about carports, accessory buildings or garage conversions are answered in the Planning FAQ section.
How to Apply
Step 1: Submit an Application
All ZBA applications are filed through the city's online permit portal. New users need a working email address to create an account, which takes about five minutes. Check the ZBA application deadline calendar before you apply.
Need help with the online application? Planning Division staff are glad to help by phone at (555) 010-8724 or in person at the office.
Step 2: Review
The Fredville Planning Division reviews each variance request, and the ZBA then considers it. A request that is denied cannot be filed again for six months. The UDC lays out each step of the approval process in detail.
What to Include With Your First Submittal
- The completed application and the application fee, both submitted through the online permit portal
- An Agent Authorization Form, signed and notarized*
- Supporting materials such as a survey, plat, plot plan, building elevations, a list of materials and photographs*
- Current tax certificates showing that no property taxes are past due*
*Upload these documents with your online application. The City of Fredville Development Guide has more detail on the process.
Fees
Application fees are listed in the fee schedule of the Unified Development Code, and the online permit portal includes a fee estimator. After you apply, Planning staff confirm that your application is complete and then send an invoice for the fee.
